Terms of Service

These Terms of Service ("Terms") govern your use of the SortKit application ("the App") provided by NerdLabs ("we," "us," or "our"). By installing or using SortKit, you agree to these Terms.

1. Service Description

SortKit is a Shopify application, embedded in the Shopify admin, that sorts the products in a merchant's collections according to a rule the merchant picks (best sellers or revenue over a recent period, margin, newest, oldest, price or stock), optionally moving sold-out products to the bottom and, on the Pro plan, keeping pinned products at the top. To do this it switches each chosen collection to Shopify's manual sort order and re-sorts it on a schedule.

2. Account and Eligibility

• You must have an active Shopify store to use SortKit.
• You must have the authority to grant SortKit access to your Shopify store.
• You are responsible for the collections and rules you and your staff set up.
• You are responsible for the security of your Shopify account and for who on your staff can access the App.

3. Pricing and Billing

• SortKit offers a Free tier, free forever: 1 sorted collection with every sort rule, re-sorted daily.
• The Micro tier is $3.99/month and allows 10 sorted collections.
• The Pro tier is $7.99/month and adds unlimited sorted collections, re-sorting every 6 hours, and pinned products.
• Paid tiers are billed through Shopify's billing system. A 7-day free trial applies to your first paid subscription.
• You may change or cancel your plan at any time through Shopify.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems to scrape or extract data from the App beyond normal use
• Resell, sublicense, or redistribute access to the App
• Interfere with or disrupt the App's infrastructure

5. Data and Privacy

Your use of SortKit is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein. SortKit reads order line items to total sales per product but stores no customer (buyer) personal data.

You retain ownership of all your store data and settings. We claim no ownership rights over your data.

6. Third-Party Services

SortKit runs on Shopify's platform and APIs. Your use of the App is also subject to the Shopify Terms of Service. We are not responsible for the availability, accuracy, or policies of third-party services.

7. Accuracy of Information

SortKit works with the information in your store. While we strive for reliability:

• Collections reflect sales, prices, costs and stock as they were at the last sort; they are re-sorted on your plan's schedule, not instantly.
• Shopify only lets SortKit read orders from the last 60 days, so sales-based rules cover at most that period.
• Margin uses the cost per item set on your products; products without a cost are placed last.
• SortKit sorts up to 5,000 products per collection; any beyond that keep their positions.

8. Limitation of Liability

To the maximum extent permitted by law:

• SortKit is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not liable for product ordering you did not expect, lost sales, or other business losses arising from the use of, or reliance on, the App.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

10. Termination

• You may terminate your use at any time by uninstalling the App from your Shopify store.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your access tokens are deleted immediately and the data held by the App will be deleted within 30 days per our Privacy Policy. Your collections keep the order they had at the time.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
